Divorce in Minnesota: Understanding the Process

Minnesota is a “no-fault” divorce state, meaning you don’t need to prove wrongdoing to get a divorce. The only requirement is an “irretrievable breakdown” of the marriage. However, that doesn’t mean the process is simple. Critical decisions must still be made about custody, support, and property division.

The divorce process begins when one party files a Summons and Petition for Dissolution of Marriage with the district court. If both parties agree on all terms, the process can move fairly quickly—this is known as an uncontested divorce.
